1. Agreement to Terms

By accessing and using the Gatecrasher K9 website, submitting inquiries, or purchasing a puppy from us, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our website or services.

2. Puppy Purchase Terms

2.1 Reservation & Deposits

• A non-refundable deposit of $500 is required to reserve a puppy
• Deposits are applied toward the total purchase price
• If your selected puppy becomes unavailable due to health issues, your deposit will transfer to another available puppy or be fully refunded at your choice
• Deposits are forfeited if you fail to complete the purchase or cancel your reservation for reasons other than puppy health issues

2.2 Payment

• Full payment is due at the time of puppy pickup
• We accept cash, bank transfer, or certified check
• Credit cards may be accepted for deposits only, subject to processing fees
• No puppy will be released until full payment is received

2.3 Pickup & Delivery

• Puppies are available for pickup at 8-10 weeks of age
• In-person pickup at our Washington facility is strongly preferred
• Ground or air transport can be arranged through professional pet transport services for an additional fee (typically $300-$600 depending on distance)
• Buyer is responsible for all transportation costs and arrangements if shipping is required
• Puppies must be picked up within 7 days of the agreed pickup date or boarding fees of $25/day will apply

3. Health Guarantee

3.1 Coverage

All puppies come with a comprehensive 2-year health guarantee covering:

• Genetic hip and elbow dysplasia (OFA/PennHIP certified breeding stock)
• Life-threatening congenital defects present at birth
• Hereditary genetic conditions that significantly impair quality of life

3.2 Exclusions

The health guarantee does NOT cover:

• Injuries, accidents, or trauma after puppy leaves our care
• Illnesses caused by neglect, improper care, or failure to follow veterinary advice
• Parasites (giardia, coccidia, worms) common in young puppies and easily treatable
• Conditions resulting from improper diet, over-exercise, or environmental factors
• Cosmetic issues that do not affect health or quality of life
• Normal puppy behaviors or temperament variations

3.3 Buyer Responsibilities

To maintain health guarantee coverage, buyer must:

• Have puppy examined by a licensed veterinarian within 72 hours of pickup
• Maintain all required vaccinations and preventative care as recommended by veterinarian
• Feed a high-quality large breed puppy food (we provide feeding recommendations)
• Avoid over-exercise and activities that stress developing joints (no running on pavement, excessive jumping, or protection training before 18 months)
• Provide written veterinary documentation if claiming a genetic health issue

3.4 Remedy

If a covered genetic condition is diagnosed within the guarantee period, buyer may choose: (1) replacement puppy from a future litter of equal value, or (2) refund of the purchase price. Veterinary expenses, transportation costs, and other incidental costs are not covered. Buyer is not required to return the affected puppy.

4. Breeding Rights & Registration

Unless explicitly stated otherwise in writing:

• Puppies are sold as companions only with limited AKC registration
• Breeding rights are NOT included in the standard purchase price
• Full breeding rights may be negotiated separately for qualified homes with additional contracts and fees
• Unauthorized breeding of a limited-registration puppy violates this agreement and may result in legal action
• We strongly recommend spay/neuter for companion homes between 18-24 months of age

5. Return & Rehoming Policy

We stand behind our dogs for life:

• Lifetime support: We provide training guidance and support for the life of the dog
• Right of first refusal: If you can no longer keep your dog for any reason, you MUST contact us first. We will either take the dog back or help you find a suitable home
• No refunds: Returns after the initial 72-hour health check period do not qualify for refunds
• Surrender fee: If we take a dog back after 6 months, a surrender fee may apply to cover boarding and rehoming costs
• Do NOT rehome, surrender to a shelter, or abandon any dog purchased from us without contacting us first

6. Buyer Representations

By purchasing a puppy, buyer represents that:

• You are at least 18 years of age
• You have experience with dogs and understand the Belgian Malinois breed characteristics
• You have a secure, appropriate living environment for a high-drive working dog
• You are financially capable of providing proper veterinary care, training, and maintenance
• You will provide adequate exercise, mental stimulation, and socialization
• You will not use the dog for illegal purposes or allow abuse/neglect
• All information provided in your application is truthful and accurate

7. Limitation of Liability

To the fullest extent permitted by law:

• Gatecrasher K9 is not liable for any injuries, damages, or losses caused by the dog after it leaves our care
• Buyer assumes all responsibility and liability for the dog's actions
• Our maximum liability under any circumstance is limited to the purchase price of the puppy
• We are not responsible for consequential damages, lost wages, emotional distress, or other indirect damages
• Buyer agrees to indemnify and hold harmless Gatecrasher K9 from any claims arising from the dog's actions

8. Dispute Resolution

In the event of a dispute:

• Both parties agree to first attempt resolution through good-faith negotiation
• If negotiation fails, disputes will be resolved through binding arbitration in Washington
• These Terms are governed by the laws of the State of Washington
• Any legal action must be brought in Washington courts
• Prevailing party in any dispute is entitled to recover reasonable attorney's fees

9. Website Use

When using our website, you agree to:

• Provide accurate information in all forms and communications
• Not use the website for any unlawful purpose
• Not attempt to gain unauthorized access to any portion of the website
• Not copy, reproduce, or distribute website content without permission
• Understand that puppy availability and pricing are subject to change without notice

All photos, videos, and content on this website are property of Gatecrasher K9 and may not be used without written permission.

10. Changes to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting to the website. Your continued use of the website after changes are posted constitutes acceptance of the modified terms. Material changes to puppy purchase terms will only apply to future purchases.
